Terms of Service

Access to Yakima Transit's Internet Service is subject to the following Terms of Service. Your accessing of the Internet Service indicates your acceptance of these terms. Yakima Transit may periodically change the Terms of Service without notice, so please check from time to time as your continued use of the Internet Service signifies your acceptance of the Terms of Service, including changed items. Yakima Transit may revise these Terms of Service at any time.

By using our Internet Service, you hereby expressly acknowledge and agree that there are significant security, privacy and confidentiality risks inherent in accessing or transmitting information through the internet, whether the connection is facilitated through wired or wireless technology. Security issues include, without limitation, interception of transmissions, loss of data, and the introduction or viruses and other programs that can corrupt or damage your computer.


Access to the Service

The Internet Service at Yakima Transit locations is a complimentary Internet Service and is completely at the discretion of Yakima Transit.

You, as a user of the Internet Service are responsible for monitoring the connectivity time and saving all data and communication prior to the expiration of the online session.

By your use of the Internet Service, you acknowledge (i) that the Internet Service may not be uninterrupted or error-free; (ii) that viruses or other harmful applications may travel through the Internet Service; (iii) that Yakima Transit does not guarantee the security of the Internet Service and that unauthorized third parties may access your computer or files or otherwise monitor your connection; (iv) that the Internet Service is provided "as is" and on an "as available" basis, without warranties of any kind, whatsoever.; and (v) that you assume all risk associated with your activities conducted online through the Internet Service and assume all liability and damages incurred by yourself, Yakima Transit, or a third party that arise or result from your activities conducted online through the Internet Service, whether known or unknown at the time of use.

Access to the Internet Service may be denied, blocked, suspended, or terminated by Yakima Transit at any time for any reason including, but not limited to, violation of these Terms of Service, actions that may lead to liability for Yakima Transit, disruption of access to other patrons or networks, and violation of applicable local, state, and, or federal laws or regulations. Use of the Internet Service shall not be construed as creating a relationship of any kind between Yakima Transit and any user of the Internet Service. These Terms of Service shall be governed, interpreted and construed according to the laws of the state of Washington. Yakima Transit reserves the right to reduce throughput or access as necessary. All communication over Yakima Transit's Internet Service is subject to monitoring.

You acknowledge that there is content available through the Internet, which may be offensive, inaccurate, or otherwise harmful. You also acknowledge that Yakima Transit does not monitor or regulate this content, and that access of content available through this Internet Service is solely at your own risk.

Activities conducted online through the Internet Service shall not violate any applicable law or regulation or the rights of Yakima Transit or any third party. Yakima Transit will fully cooperate with law enforcement upon receipt of notice that use of the Internet Service is in violation of applicable law. YAKIMA TRANSIT HEREBY DISCLAIMS ANY AND ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT AND TITLE, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. YAKIMA TRANSIT DOES NOT WARRANT THAT THE INTERNET SERVICE WILL PERFORM AT A PARTICULAR SPEED OR THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.


Limitation of Liability

You acknowledge and agree that Yakima Transit shall not be liable for any claim arising out of, related to, or in any way involving the use of the Internet Service. ANY AND ALL LIABILITY FOR NEGLIGENCE IN PROVIDING OR SECURING THE INTERNET SERVICE IS EXPRESSLY PRECLUDED. YAKIMA TRANSIT SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY INDIRECT, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, INCIDENTAL, OR SPECIAL DAMAGES, OR LOST PROFITS, WHETHER FORESEEABLE OR UNFORESEEABLE, THAT ARISE OUT OF, RELATE TO, OR IN ANY WAY INVOLVE USE OF THE INTERNET SERVICE.


Indemnification

You agree to hold harmless and indemnify Yakima Transit from and against any third party claim arising from, related to, or in any way involving your use of the Internet Service, including any liability, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorney fees, of any kind or nature.


Children

Yakima Transit requests that parents supervise their children while online or utilizing the Yakima Transit App. No personal information should be provided by minor children without parental consent. When Yakima Transit collects personal information from children using our website, it complies with the Federal Children's Online Privacy Protection Act.


Jurisdiction

Any dispute arising from these terms shall be resolved exclusively in the state and federal courts located in Washington.
